ONE OF A KIND AUCTION
CONDITIONS OF PARTICIPATION

  1. Pinion GmbH (Heerweg 19, 73770 Denkendorf; hereinafter “Pinion”) is the organiser of the Internet auction in which a deconstructed “exploded” gearbox object is to be auctioned off to the highest bidder (ONE OF A KIND auction). All gearbox parts of the P-line (P1.18) are mounted on the object. The minimum bid of 1,118.00 euros applies.
  1. The Internet auction will start on 4 July 2022 at 12:00 CEST and end on 14 July 2022 at 23:59:59 CEST
  1. The winner of the Internet auction will receive the auctioned artwork in the condition and state existing at the time of handover to the winners. Warranty rights are excluded.
  1. The bidder submits a binding and unconditional offer to conclude a contract for the purchase of the artwork listed at “pinion.eu/en/one-of-a-kind”. The minimum bid is 1,118.00 euros.

For this purpose, the bidder shall fill in the form on the aforementioned website stating the bid amount in euros as well as full contact details (first name, surname, e-mail, shipping address, telephone number).

  1. Minors and employees of Pinion GmbH are not entitled to participate. Pinion GmbH will accept the highest bid at the time of the conclusion of the auction. In return, the winner will receive a notification e-mail at the e-mail address provided with notification of the successful bid. Only upon receipt of this e-mail will a contract be concluded between Pinion GmbH and the winner.

The contract obliges the winner to pay the purchase price in the amount of the bid submitted and Pinion GmbH to transfer ownership of the artwork. If two or more bidders have submitted an identical bid value which represents the highest bid at the end of the auction, the earliest bid received will be accepted. The current highest bid will be communicated via www.pinion.eu/oneofakind.

  1. If the highest bid at the end of the bidding period is invalid for legal reasons, Pinion GmbH will accept the bid of the bidder who has submitted the highest valid bid at the time of the end of the auction.
  1. Pinion GmbH stores and processes the data provided by the bidder for the purpose of conducting the auction and processing the contract. The data will be deleted after the auction has ended and the purchase contract has been processed unless legal regulations necessitate a longer storage period. Pinion GmbH complies with the legal provisions applicable to the protection of bidders’ data. Further information on data protection at Pinion can be found at: https://pinion.eu/en/privacy-statement/
  2. Bidders may only withdraw bids if there is a justified reason for doing so. After a justified bid withdrawal or if the highest bid is invalid for legal reasons, Pinion GmbH will accept the bid of the bidder who has submitted the highest valid bid at the time of the end of the Internet auction.
  1. The purchase price does not include delivery and shipping costs. Pinion GmbH and the highest bidder shall come to an amicable agreement on the handover and transfer of ownership of the artwork. The shipment of the artwork to the highest bidder(s) is not part of the purchase contract.
  1. Payment by the highest bidder of the successful bid amount for the purchase of the artwork shall be due on the date listed in the notification e-mail received after the closing of the auction by the successful bidder. The payment shall be made directly to the account specified in the notification e-mail. The relevant payment information will be communicated to the highest bidder in the notification e-mail about the successful bid. If the highest bidder does not pay within the period specified in the notification e-mail, the statutory provisions on default of payment shall apply.
  1. Pinion GmbH will donate the purchase amount to the organisation “Bike Bridge e.V.”. More information about the association is available at bikebridge.org.
  1. Legal recourse is excluded
